my neighbors,every year when it starts getting warm,drink up a storm every sunday.Well today,my kids and i were planting flowers in our yard with the freestyle blazing,of course after i listen to sinatra from 9-12.Anyway,they yell to me that the music is old as hell,meanwhile they are blasting donna summer,and their disco music.so i said if my music is old,then your shit is ancient.they didnt like that too much.the guy wanted to fight,saying ill show you ancient,and cursing in front of my kids.this idiot drunk as hell,tried to hop the fence.my kids are crying,and me being 6'2,waited till he got to the top,and told my kids to go in the house.when they went in,i came back to the fence,and blasted him back to the other side.was i wrong,first no one curses in front of my kids,and 2 no one makes them cry.its not my fault they cant handle alcohol. ITS GONNA BE A LONG SUMMER!!!!!!!!!

Well I don't think you are wrong for defending your children and your property because he was atttempting to climb over YOUR fence and attack you in front of YOUR children.

Since you know they get out of hand when they drink, I would not respond to their comments when they start in on you - I would just quietly pick up the phone and let the cops come and take care of them. I would be careful about "blasting him over to the other side" because even though this time he was attempting to trespass on your property he could still try and have YOU arrested for assault which might cause problems with you being able to take your kids to your house - it's not worth it...
 
Actually it all depends on the state. If someone comes on to your property you do not have the right to assualt them etc. The most you could do is call the police. Now if he comes on your properyy with a gun, knief, bat, saying I'm going to kill you, them yes you may. Key word "may".

In NY you can not just hit, or shot a person for just waling onto your property. There has to be a deadly physical threat. And once you put the person down you can not keep going. If you do then you will still be charged.

You will propbably be brought in etc etc. And let the cops do their investigation. But I won't get into to that.

The best thing to do is just walk into the house and call the cops. Don't even say a word.
 
i agree w/ everyone but knowing me i woulda prob done the same. i ain't gonna let no one get stupid w/ me let alone act a fool in front of my kids. i react b4 i think
